1. Acceptance of Terms

By downloading, installing, creating an account, or using KYN (“the Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, please do not use the Service. We may modify these Terms at any time by posting an updated version, and your continued use after the “Last updated” date means you accept those changes.

2. The Service

KYN is a financial awareness tool designed to help you track and reflect on your spending. The Service includes our mobile app, website, and any related features or content we provide. We may update, improve, or remove features at our discretion, including those offered in free or premium tiers, without liability to you.

3. Eligibility & Registration

You must be at least 16 years old to use the Service. If you are under the legal age of majority in your country, you must have parental or guardian consent. You are responsible for maintaining the security of your account and any actions taken under it. You agree to notify us immediately if you become aware of any unauthorized use of your account or any breach of security.

4. Freemium & Premium Subscription Model

KYN is offered under a freemium model. The free tier is always free to use, displays ads, and provides limited access to certain features and usage limits such as the number of accounts and presets. The premium subscription is a paid plan offering no ads and access to additional features and higher limits. Premium subscriptions renew automatically unless cancelled. If you cancel your premium subscription, you will retain access to the free tier; however, any content created using premium features will remain visible but may not be editable using free-tier tools, and premium-only features will become inaccessible. We reserve the right to adjust the benefits of each tier, including free and premium features, without changing these Terms.

5. Payments & Billing

Premium subscriptions are billed in advance on a recurring basis through the app store or platform from which you purchased. Cancellations take effect at the end of your current billing cycle. Refunds are subject to the policies of the app store or payment provider used for purchase. We do not process refunds directly unless required by law.

6. Advertising

Free-tier users will see advertising within the Service. These ads may be targeted based on limited, non-identifiable information. We do not sell your personal financial transaction data to advertisers.

7. Your Content & Rights

You retain ownership of all content you input into KYN, such as transactions, categories, and notes. By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, and display your content solely for the purpose of operating the Service. You are responsible for ensuring that your content does not infringe on the rights of others.

8. Prohibited Activities

You agree not to use KYN, including our mobile app, website, and any related services, in any way that violates laws or rights, misuses the Service through unauthorized access or tampering, compromises security or stability by transmitting malware or disrupting the Service, harasses or harms others by transmitting unlawful or abusive content, engages in fraudulent activity such as creating false accounts or scams, or abuses free or premium access by bypassing limits or sharing accounts. Violation of this section may result in suspension, termination, removal of content, and legal action.

9. User Responsibilities and Data Accuracy

You agree to provide accurate, current, and complete information when using the Service, especially when entering financial transactions or related data. The quality and usefulness of the insights, analytics, and reports generated by KYN depend on the accuracy and completeness of your input. We are not responsible for decisions made based on inaccurate or incomplete data entered by you. You must not input fraudulent, misleading, or false data.

10. Service Modifications, Interruptions & Availability

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability. We may experience interruptions due to maintenance, technical issues, or causes beyond our control. We do not guarantee continuous or error-free operation and are not liable for downtime or data loss.

11. Termination

These Terms remain in effect as long as you use the Service. We may terminate or suspend your access, without notice or liability, for any reason including violation of these Terms or applicable law. Upon termination, you may not register a new account under your own or a third party’s name. Termination does not limit our right to take legal action. You may also close your account at any time by following instructions in the app.

12. Intellectual Property

All KYN trademarks, logos, software, designs, and intellectual property are owned by us or our licensors. You are granted a personal, non-transferable, revocable license to use the Service for personal, non-commercial purposes only. Unauthorized use of our intellectual property is prohibited, including in domain names, third-party apps, or advertising.

13. Limitation of Liability

Our total liability to you is limited to the greater of the amount you paid us in the last 12 months or USD $50. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data. Some jurisdictions do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless KYN and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your use of the Service, breach of these Terms, violation of rights of others, or harmful acts toward other users. We may take control of the defense and require your cooperation.

15. User Data and Backup

We maintain routine backups but are not responsible for loss or corruption of your data. You are solely responsible for any data you input or actions taken using the Service.

16. Electronic Communications

Your use of the Service and communications with us are electronic. You consent to receive all agreements, notices, and disclosures electronically, including via email or within the app. You agree that electronic signatures and records satisfy any legal writing requirements.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Any disputes will be resolved exclusively in courts located in Dubai, UAE, unless mandatory local law provides otherwise.

18. Miscellaneous

These Terms and related policies constitute the entire agreement between you and KYN. Our failure to enforce any provision does not waive our rights. If any part is found unenforceable, the remainder will remain in effect. No partnership or agency is created by these Terms. We may assign rights or obligations without notice. Force majeure events, such as natural disasters or technical failures, release us from liability for delays or failures.
